By running fewer trains, the MTA is exacerbating crowding conditions on platforms and inside trains during a pandemic, resulting in a health hazard. The MTA cut service systemwide in April 2020 on all subway lines as ridership plummeted to approximately 300,000 a day. It has restored service except on the C and F lines. Ridership has grown significantly with more than 1.9 million passengers on Thursday, March 12, 2021, a pandemic record.

TWU Local 100 Vice President Eric Loegel and Miguel Acevedo, president of the Fulton Houses Tenant Association, are plaintiffs in the lawsuit.
